The emergency regulation on BPA under Prop 65 applies

California’s Office of Environmental Health Hazard Assessment (OEHHA) has finalised the emergency regulation regarding warning for exposure to bisphenol A (BPA) from canned and bottled foods and beverages under Proposition 65 (“Prop 65”). On 18 April 2016, the emergency regulation took into force immediately upon approval of Office of Administrative Law (OAL) and. It will be valid until 18 October 2016.
During the six months from 18 April to 18 October, vendors only need to provide uniform warnings on the point-of-sale to inform consumers of BPA hazard in products so as to comply with warning requirements of Prop 65.
The finalised requirement is slightly different from that published on 1 April but with the warning contents unchanged. Please click the linked news below for more details.
Currently the EU has notified WTO to amend Regulation (EU) No 10/2011 to lower BPA limits in plastic and varnished or coated food contact materials and articles. The French competent authority of REACH also intends to submit proposal to list BPA as an SVHC. Seeing from the above, the regulation on BPA is more stringent. C&K Testing advises importers and exporters to control BPA present in products especially teats and feeding bottles.
