California's Office of Environmental Health Hazard Assessment (OEHHA), on July 1, 2013, approved a Maximum Allowable Dose Level of 1,200 micrograms per day for BBP.

The OEHHA proposed the MADL on 1 June 2012, and responded to the public comment received on that proposal in July 2012. As part of a separate Proposition 65 process, the OEHHA's Science Advisory Board Carcinogen Identification Committee is reviewing butyl benzyl phthalate for possible listing under Proposition 65 as a carcinogen.

BBP is commonly used as a plasticizer for vinyl foams, which are often used as floor tiles. Other uses are in traffic cones, food conveyor belts, and artificial leather. BBP was listed as a developmental toxicant under California's Proposition 65 on December 2, 2005.

The US Consumer Product Safety Improvement Act of 2008 bars the use of butyl benzyl phthalate as a plasticiser in childcare products and toys at concentrations greater than 0.1%.
