Notification on implementation of new Chinese cosmetics standard

Safety and Technical Standards for Cosmetics (Version 2015) (“Standard”) was published on 23 December 2015. China Food and Drug Administration (CFDA) has published Notification No. 108 of Year 2016 on 1 June 2016 for the implementation of the standard.

The highlights of the notification are as follows:
1. Cosmetics that not complying with the Standard are forbidden to be manufactured or imported since 1 December 2016. However, those products available on the market can be offered for sale until their expiry date. When only Use Conditions and Points for Attention marked on the label should be changed to comply with the new standard, the original packaging can be used until 30 June 2017 and those products available on the market can be offered for sale until their expiry date.
2. For cosmetics which have been approved or recorded for filing, businesses shall apply to the CFDA departments for change in case any adjustment to the formulation.
3. For cosmetics which have been approved or recorded for filing, if the technical documents do not comply with the Standard, businesses shall adjust relevant documents before 1 December 2016 to meet the new requirements.
4. For cosmetics which have been approved or recorded for filing, when only their Use Conditions and Points for Attention marked on the label do not comply with the Standard, businesses can submit revised labels upon application for approval.
5. Competent departments should intensify efforts on publicity and training of the Standard.
