Interpretation on Imported Paints Filing Guidance Documents

According to the "Order of the General Administration of Customs. P.R.China" (No. 238, No. 240) and the "Announcement of the General Administration of Customs. P.R.China" (No. 34 of 2018), manufacturers, importers or import agents of Imported Paints (Hereinafter referred to as the filing applicant) may apply to the filing agency for the filing of imported paints as needed. The operation process is as follows:

1. Apply for filing

The filing application should be submitted to the filing agency at least 2 months before the import of paint, and the filing applicant should submit the application materials. Details are as follows:

a) "Imported Paint Filing Application Form" (see Annex 1).

b) A declaration by an imported paint manufacturer that the content of hazardous substances in its products meets the requirements of the national technical specifications of the People’s Republic of China (see Annex 3).

c) Regarding the basic composition, brand, model, origin, appearance, label and marking of Imported Paint products, packaging manufacturer and location, packaging product label and other related information(the Chinese version shall prevail) (see Annex 4).

The filing applicant can submit the application documents on site, or communicate with the acceptance contact person in advance, and send the electronic version of the filing application documents to the dedicated mailbox for import coatings filing by email, and indicate the address, name and contact information of the filing applicant.

2 Accept Filing

After receiving the filing application, the filing agency will review the qualifications of the filing applicant and the documents provided, and issue the “Notification of Acceptance status of Imported Paint Filing Application” within 5 working days (see Annex 5).

3 Special testing

After the filing applicant received the “Notification of Acceptance status of Imported Paint Filing Application”, if the application is accepted, the filing applicant shall send or mail the inspected samples to the testing laboratory designated by the General Administration of Customs to apply for testing. The samples provided by the filing applicant should be consistent with the actual Imported Paints, and the number of samples should meet the needs of special testing and sample retention; If the application is not accepted, the application can be re-applied after supplementing and rectifying in accordance with the “Notification of Acceptance status of Imported Paint Filing Application”.

4. Issue filing book

The special testing laboratory shall complete the special testing of the sample and the special test report of Imported Paint within 15 working days after receiving the sample, and submit the test report to the filing agency.

Within 3 working days after receiving the special test report of Imported Paints, the filing agency shall conduct an audit in accordance with relevant regulations and special test reports, and issue the "Imported Paint Filing Form" (see Annex 6) if the audit is qualified; If the applicant failed to pass the review, the applicant shall be notified in writing.
