On 20 February 2017, European Commission notified World Trade Organisation (WTO) of a proposed restriction of octamethylcyclotetrasiloxane (D4) and decamethylcyclopentasiloxane (D5) in cosmetic products that are washed off in normal conditions of use by Notification G/TBT/N/EU/456. It intends to set a limit of 0.1% for such cosmetic products. The draft is expected to be adopted in the second half of 2017.
In Annex XVII to Regulation (EC) No 1907/2006, the following new entry is added:

Condition | 1. Shall not be placed on the market in wash-off cosmetic products in a concentration equal to or greater than 0.1% by weight of either substance, after [date – twenty four months after the entry into force of this Regulation]. 2. For the purposes of this entry, ‘wash-off cosmetic products’ means cosmetic products as defined in Article 2(1)(a) of Regulation (EC) 1223/2009 that, under normal conditions of use, are washed off with water after application.” |
The Agency's Risk Assessment Committee ('RAC') concluded D4 meets the criteria in Annex XIII to REACH Regulation for the identification of a persistent, bioaccumulative and toxic ('PBT') substance and a vPvB substance and that D5 meets the criteria for the identification of a vPvB substance. So the two substances can possibly give rise to environmental hazards during the normal use of washed-off cosmetics.
The restriction will take into force on the twentieth day following its publication on the Official Journal of the European Union. C&K Testing reminds that businesses have a 24-month period for technical adjustment if it is finalised.
