19 December 2017, European Commission issues proposal 2017/0353, including 11 chapters comprising 64 articles and one annex.
This proposal is consistent with the proposal for a regulation on market surveillance of products which was adopted by the Commission in February 2013 [COM(2013)75] as part of the "Consumer Product Safety and Market Surveillance Package".
Union harmonisation legislation on products as listed in the Annex to this proposed regulation provides the specific framework for marketing each category of products it covers, and thus the obligations of each business in the supply chain.
The proposal revised the basic requirements of product compliance process, and strengthens the enforcement power of market regulators to curb the amount of non-regulatory products that are rising in the EU market in recent years.
The proposal stipulates that any products covered within the scope of the regulations that are sold in the EU market must have the "authorized product compliance person" in EU, and the correct details of the "compliance person" should be marked on the product. Otherwise those products will be regarded as unregulated products, and not allowed to sell. "Authorized product compliance person" in EU shall be responsible for the following:
1. Safekeeping compliance declarations and compliance technical documents of products in the legal period.
2. If the market regulator requires, the person must immediately provide the market regulatory authorities with detailed product compliance technical documents, and explain the real compliance process of the products.
3. If the product is not in compliance with the regulations, the product must be corrected or recalled in accordance with the requirements of the market regulator.
The proposal also gives EU market regulators super-enforcement powers and the necessary financial and material resources for enforcement activities. The European Commission is required to set up a central secretariat for the unified regulation and coordination of market regulation and enforcement actions in member states.
