EU notifies WTO of proposals on three exemptions

On 17 November 2016, the European Commission has submitted notifications G/TBT/N/EU/423, G/TBT/N/EU/424 and G/TBT/N/EU/425 aiming to renew or revise the three existing exemptions under RoHS Annex III.

Oeko-Institute was entrusted by the European Commission to hold a stakeholder period for the three exemptions during April to June 2015 and it published a final report containing the assessment of the application in Feb. 2016. In the notifications, it will renew the exemption date for category 1 large household appliances till 21 July 2019, but the durations for category 8 and 9 that are not expiry remain the same. The durations for13(a) and (b) are consistent with related suggestions.

Lead in white glasses used

for optical applications

Applies to all categories; expires on:

21 July 2023 for category 8 in vitro diagnostic medical devices;

21 July 2024 for category 9 industrial monitoring and control instruments and for category 11;

21 July 2021 for all other categories and subcategories

13(b)

(1) Cadmium and lead in filter glasses and glasses used for reflectance standards

Applies to categories 8, 9 and 11; expires on:

• 21 July 2023 for category 8 in vitro diagnostic medical devices;

• 21 July 2024 for category 9 industrial monitoring and control instruments and for category 11;

• 21 July 2021 for other subcategories of

categories 8 and 9

(2)Lead in ion coloured optical filter glass types

Applies to categories 1 to 7 and 10; expires on 21 July

2021 for categories 1 to 7 and 10

(3)Cadmium in striking optical filter glass types; excluding applications falling under Ex. 39 of

this Annex

(4)Cadmium and lead in glazes used for reflectance standards

Comments on the Commission's proposals must be submitted within 60 days of the WTO notification date of 17 November. It is expected that the above exemptions to be adopted in Feb. 2017.
