EU notifies WTO of draft cadmium exemption under RoHS directive

On 10 February 2017, EU notifies WTO of a draft amendment to exemption 39 of Annex III as regards the use of cadmium in certain colour converting light-emitting diodes (LEDs) by Notification G/TBT/N/EU/452. It renews two-year duration for the exemption to allow sufficient time for economic operators. The draft will be approved in May 2017 and take into force on the twentieth day following its publication in the Official Journal of the European Union.

The current Annex III exemption 39 permits the use of cadmium in certain colour converting light-emitting diodes (LEDs) for lighting and display applications. The exemption ends on 1 July 2014, but EU commission received applications for renewal. A final assessment report was finalised in June 2016, which suggested three-year duration for exemption. In the draft, the final decision for exemption is two years. In Annex III to Directive 2011/65/EU, point 39 is replaced by the following:

39

Cadmium selenide in downshifting cadmium-based semiconductor nanocrystal quantum dots for use in display lighting applications (< 0.2 μg Cd per mm2 of display screen area)

Expires for all categories on [two years after the publication of the Delegated Directive in the Official Journal]"

Exemptions decide that whether businesses are required to comply with the limits set forth in Annex II under RoHS Directive. C&K Testing advises manufacturers should follow up the exemptions which will update along with technological development to ensure RoHS Directive compliance.
