On March 23, 2017, the European Commission submitted to the WTO regular notification G/TBT/N/EU/460, intending to amend the EU RoHS 2 Directive (2011/65 / EU) to explicitly stipulate the implementation time and the maximum exemption period of the 11th category of products, and to officially exclude pipe organs, non-road mobile machinery fitted with a cord‑connected traction drive in its scope of RoHS 2.
According to the EU RoHS2.0 Directive, for products which are not included in Directive 2002/95/EC (RoHS1.0) but belong to the new-added objects, July 22, 2019 is the deadline of the implementation time to fulfill the requirements of RoHs 2 Directive. As the article 4 of RoHS 2 Directive specifies the limits need to be met, the implementation time and the maximum duration of Exemption of the 1st to the 10th categories of products, the deadline of July 22, 2019 refers in particular to the 11th category of products (electrical and electronic equipments not belong to the above categories). And the scope of products covered in RoHS directive could be obtained in analysis of RoHS directive.
According to the draft, this amendment mainly concerns the following points:
1. Clarify that the 11th category of products which are first launched should meet RoHS Directive, and the second market operations, which includes recycling and reselling, are not covered;
2. Exempt repair with spare parts of the 11th category of electrical and electronic equipments which were legally marketed before July 22, 2019;
3. Define the implementation time of RoHS Directive on the 11th category of products and the maximum exemption period of relevant exempt purpose;
4. Exclude pipe organs from the scope of RoHS Directive;
5. Redefine “non-road mobile machinery for professional use only” so as to exclude non-road mobile machinery fitted with a cord‑connected traction drive from the scope of RoHS Directive.
