30 May 2018, the Official Journal of the European Union released the directive (EU) 2018/852, amending directive 94/62/EC on packaging and packaging waste.
This directive, on one hand , aims to protect, preserve and improve the quality of the environment, protect human health, ensure prudent efficient and rational utilization of natural resources and enhance the use of renewable energy, to prevent any impact from packaging and packaging waste on the environment or to reduce such impact, thereby providing a high level of environmental protection, on the other hand, to ensure the functioning of the internal market and to avoid obstacles to trade and distortion and restriction of competition within the Union.
The main amendments are as follows:
1. Modified the purpose of instruction development, the definition of packaging, and some conceptual and textual descriptions, the terms of the recovery systems and the provisions of Annex II and Annex III.
2. Added the recovery standard of specific substance, the date and the recovery condition, the Rules on the calculation of the attainment of the targets, the early warning report as well as the Annex IV.
3. Deleted some descriptive words, case clauses, etc.
This Directive is addressed to all the Member States, which shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 5 July 2020. This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union (i.e.19 June 2018).
