On July 31, 2017, CFDA released the notification:Department of Drug and Cosmetics Supervision [2017] No.103, which indicates CFDA would issue the Cosmetic Spot-check Supervision Specification, in order to standardize the spot-check supervision process, according toCosmetic Health Supervision Regulationsand related regulations.

According toCosmetic Spot-check Supervision Specification,supervision and check work involves:

1. cosmetic production license, approval certification, business license of related manufactures and compliance between the licenses and products.

2. compliance between product labels and articles of approval certification. Whether there are false labels and illegal advertisements.

3. The purchase certificate management.

If any following conditions are founded during inspection, targeted inspections may be adopted.

1. use the forbidden materials, unapproved new materials or exceed level of restricted substances;

2. use illegal materials, excipients, and container or package which contact cosmetics directly.

3. cosmetics are suspected tainted

4. other cosmetic safety issues which not involve above.

Meanwhile, manufactures shall pay attention to label issues mentioned above. If not, all these illegal issues could finally result in targeted inspections

Both Cosmetics CFDA Registration and Administrative License are important parts of compliance. Inspection progress is based on whether the inspection samples have been registered and the authenticity of manufactures, address of agent and approval certification. Cosmetics without registrations and administrative licenses will be investigated by laws. What’s more, overdue cosmetics, cosmetics without effective date or production date will be confiscated directly.

Unqualified cosmetics will be confiscated by sealing exiting products, stopping manufacture and sold, recalling back and other measures. Caution will be adopted when necessary. Manufacturer will be charged by administration with laws.

Note that for unqualified products, government will give a follow-up inspection.

Cosmetic manufactured by those who are unable to do inspection is an emphasis when spot-check.
