California has extended its emergency regulations on Proposition 65 warnings for bisphenol A (BPA) in canned and bottled food and drink by 90 days. The existing regulations had been to expire on 17 October.

California’s Office of Environmental Health Hazard Assessment (OEHHA) has finalised the emergency regulation regarding warning for exposure to bisphenol A (BPA) from canned and bottled foods and beverages under Proposition 65 (“Prop 65”) in April (Our report: The emergency regulation on BPA under Prop 65 applies).

California's Office of Administrative Law has now agreed the emergency regulations will be in place until 17 January. If Oehha adopts the formal rulemaking before this time, it will supercede the stopgap measure.
