The Food and Drug Administration (FDA) released a final rule (File Number FDA-2016-F-1805) on the American Federal Register (FR) on May 4, 2017, amending the food additive regulations that no longer permit to use potassium perchlorate as an indirect additive in the production of the closure-sealing gaskets of food containers.

Based on this final rule, Code of Federal Regulation, in view of the circumstance that the closure-sealing gaskets manufacturing industry does not use potassium perchlorate any longer, will make the following amendment in 21CFR 177:

In § 177.1210, in paragraph (b)(5), in table 1, remove the entry for “Potassium perchlorate.”

Relevant corporations should submit application document (like Food Contact Notification (FCN) or food additive petition) to FDA if they need to continue their use of potassium perchlorate in the closure-sealing gaskets of food containers.

This final rule becomes effective from May 4, 2017, and the public could submit relevant submissions before June 5. C&K Testing advises relevant corporations to pay close attention to the amendment of FDA regulations.
